§ 58-53. Removal of solid waste from parcels of real estate subject to this article.

  • Whenever solid waste shall not be contained or removed as required by this article or is disposed of in an improper manner, the commission may direct the removal of such material by a licensed collector. In such event, a licensed collector shall, within the time specified by the commission (which time shall not be less than within 24 hours of being so directed, Saturdays, Sundays and holidays excluded), make such collection and removal. Whenever a licensed collector is directed to remove solid waste from any parcel pursuant to this section, the commission shall make a written record of such action and provide a copy to the licensed collector. If such collection and removal requires an expenditure of time and effort comparable to that required for ordinary collections, the collector shall be paid by the commission at its regular rate for ordinary collections. The fee for such collection shall be paid by the commission and recovered from the owner of the premises from which such collection and removal is made.
